Public procurements and related selection processes are not
only relevant for the public sector, but entrepreneurs in the private sector
also often encounter them - most often when they receive subsidies. In such a
case, they are often obliged to select their suppliers in the form of a public procurement,
or a procedure derived from them.
Although the regulation of public procurement should be
simple so that the entire public administration can apply it correctly, we know
from our own experience that this is not necessarily the case every time, and
in our work we often come across areas and questions that require complex legal
analysis. Failure to comply with the rules when awarding public contract can
have fundamental negative consequences for the procuring authority – from the
prohibition to conclude the given contract, whereby the procuring authority
loses several months spent on failed procurement procedures, through
significant fines to – in the case of the private sector – the risk of losing
the subsidy for which the procuring authority applied.
Our team has extensive experience in the preparation and administration of public procurements, having provided these services to both large public procuring authorities (e.g. statutory cities) and leading Czech companies. We focus on "turnkey public procurement" services, where we prepare all the documentation and also ensure the organization and administration of the entire procurement procedure, and the only thing left for the procuring authority (apart from a few decisions that cannot be transferred to another entity by law) is to conclude a procured contract at the end. However, we can also advise in case of specific problems or, for example, just prepare the necessary documentation. At the same time, we help the client set up the entire process to meet his requirements, and we can also advise on setting up competed contracts. In addition, we have already prepared for clients an audit of their previously awarded public contracts within procurements in order to detect potential errors.
We also work closely with subsidy advisors and are therefore able to deliver a complete package of services including both subsidy services (subsidy selection, application submission and administration) and subsidy preparation and administration services required for a public procurement or similar procedure.
